Los Customs ("the App", "the Service") is operated by 17558937 Canada Inc. ("we", "us"), a corporation incorporated in Canada. By downloading or using the App you agree to these Terms. If you don't agree, don't use the App.
Los Customs lets you photograph a car, or pick one from our catalog, and see AI-generated images of it with modifications such as paint, wheels, body kits and style effects. You can view your builds from several angles and keep a collection of cars.
Every modified image is generated by artificial intelligence. It is a creative visual, not a photograph, a design drawing, an engineering assessment or a guarantee that a real part exists, fits your car or is legal where you live. Don't rely on it for purchasing, fitment, safety or legal decisions.
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use it only with the permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for any purchases.
When you first open the App, we create an account for your device automatically. You can sign in with Apple to keep your garage and use it on other devices. You are responsible for activity on your account and for keeping your device and Apple ID secure. You can delete your account at any time from the account page in the App.
You keep ownership of the photos you upload. To run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and modify your photos, and to send them to the service providers listed in our Privacy Policy, solely to generate your images and operate the App. This licence ends when you delete the content or your account, except for copies kept in backups for a limited time.
For every photo you add, you confirm that you took it yourself or have all the rights needed to use it this way, that it isn't someone else's copyrighted photo you found online, that you have the consent of any identifiable person in it, and that it doesn't break any law or anyone's privacy, publicity or intellectual property rights. Photograph cars, not people. Don't upload anything illegal, hateful, sexual or violent. We remove infringing material and close the accounts of repeat infringers.
Never use the camera or look at the App while driving or operating any vehicle. When you photograph a car, stay on safe, legal ground, respect private property and other people, and never put yourself or anyone else at risk for a shot. You are responsible for your own safety and conduct, and to the extent permitted by law we are not liable for any injury, damage, fine or other loss that results from how you use the App in the real world.
Subject to these Terms, you may use the images the App generates for you for personal use, including sharing them on social media. Results may be inaccurate, inconsistent, or similar to images generated for other users, and we don't guarantee any particular result. We may refuse or remove any request or output at our discretion.
We love showing off what people build. You give us a worldwide, non-exclusive, royalty-free licence to use, copy, edit and display the images the App generates for you, and the car cut-outs it makes from your photos, to promote Los Customs (for example on our website, social media, ads and App Store listing) and to illustrate cars in the App's catalog. We may crop them, remove backgrounds and blur or replace number plates.
We won't use your name, username or the rest of your original photo without asking you first, and we won't sell your images to anyone. If you'd rather your builds weren't featured, email support@loscustoms.com and we'll stop using them in new material. Material we've already published, and images already added to the catalog, may stay up.
Rendering costs us real money, so requests are rate-limited. Automated, scripted or bulk use isn't allowed and may be blocked.
The App, its design, art, characters, software and catalog are owned by us or our licensors and protected by law. Car makes, models and logos are trademarks of their owners and are used only to identify vehicles. Los Customs is not affiliated with, endorsed by or sponsored by any vehicle manufacturer or game publisher.
We give you a personal, limited, non-transferable, revocable licence to use the App on Apple devices you own or control, under these Terms and Apple's Standard End User Licence Agreement.
Some car descriptions and facts in the App are adapted from Wikipedia and are available under the Creative Commons Attribution-ShareAlike 4.0 License.
If you believe something in the App infringes your copyright, email support@loscustoms.com with your contact details, the work, where the material appears, a statement that you believe in good faith the use isn't authorised, a statement that your notice is accurate and you are authorised to act, and your signature. We'll remove or disable the material where appropriate.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We don't promise the App will be uninterrupted, error-free or that results will meet your expectations.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR CAD $50 IF GREATER. Some places don't allow these limits, so they may not apply to you.
You agree to cover us against claims, losses and costs (including reasonable legal fees) arising from content you upload, your misuse of the App, or your breach of these Terms.
You can stop using the App and delete your account at any time. We may suspend or end your access if you break these Terms or if we stop offering the App. Sections that by their nature should survive, including 5, 8, 12, 14, 15, 16 and 18, survive termination.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be resolved in the courts of Ontario, unless the law where you live gives you the right to bring a claim in your local courts. Please contact us first so we can try to resolve it informally.
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the App, including product liability, legal or regulatory compliance and intellectual property claims. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
We may update these Terms. If a change is significant, we'll let you know in the App or by email before it takes effect. Continuing to use the App after a change means you accept the new Terms.
If any part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a right isn't a waiver of it. These Terms and our Privacy Policy are the whole agreement between you and us about the App. You may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale of our business. We aren't liable for delays or failures caused by events outside our reasonable control, including outages at our hosting, AI or payment providers.
